TERMS OF AGREEMENTS
Due to our early stage of development, it is crucial that some principles are constantly taken into account.
We named them Terms of Agreements.
Article 1 - Definitions
The following definitions apply in these terms and conditions:

Trader: the legal person who acts in the context of his trade, business, craft or professional activity, whether or not also through another person acting on his behalf or for his account;

Consumer: any natural person who acts for purposes that fall outside his business or professional activity;

Distance agreement: the agreement concluded between the trader and the consumer in the context of an organized system for distance sales or services without the simultaneous personal presence of the trader and the consumer and whereby, up to and including the conclusion of the agreement. Use is made exclusively of one or more means of distance communication;

Technology for distance communication: means that can be used to conclude a contract, without the consumer and trader being in the same place at the same time;

Cooling-off period: the period within which the consumer can make use of his right of withdrawal;

Right of withdrawal: the possibility for the consumer to cancel the distance agreement within the cooling-off period;

Day: calendar day;

Duration transaction: a distance agreement with regard to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;
Article 2 - Applicability

These general terms and conditions apply to every offer from P&M Network and to every distance contract concluded between the trader and the consumer.

Before the distance agreement is concluded, the text of these general terms and conditions is made available to the consumer. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions can be viewed and they will be sent free of charge as soon as possible at the request of the consumer.
Article 3 - The offer

If an offer has a limited duration or is subject to conditions, this will be explicitly stated in the offer.

P&M Network reserves the right to change or cancel the course at any time, if necessary, in part. If the course is partially cancelled, you will be returned pro-rata for the part for which no course has been taken. With a full cancellation, the full amount will be returned.

The use of images, photos and texts of P&M Network on websites and merchandise of third parties is not permitted without permission from the management of P&M Network.

Each offer contains such information that it is clear to the consumer what rights and obligations are attached to accepting the offer. This concerns in particular:

the manner in which the agreement is concluded and which actions are required for this;

the method of payment or implementation of the agreement;

the period for accepting the offer or the period for which the price is honoured;

the date(s) and timeslot(s) of the courses;

Article 4 - The agreement

The agreement is concluded at the time the consumer accepts the offer and meets the corresponding conditions.

If the agreement is concluded electronically, P&M Network takes appropriate technical measures to protect the electronic data transfer. As the customer pays electronically, P&M Network observes the necessary security measures. In that respect, P&M Network has entered into agreements with trustworthy payment companies.

Upon acceptance of a distance agreement, the latter can only be changed with the consent of the management of P&M Network.
Article 5 - Refund and change course

Restitution is not possible unless the law provides otherwise. The relevant course time can be changed up to three days before the start of a course.

P&M Network may also cancel a course written or electronically in any event. Cancellation must be done written or electronically and under clear mentioning of reasons for cancellation. Cancellation leads to annulment of the agreement with the customer and P&M Network must pay back already paid amounts within 14 days after the date of cancellation.
Article 6 – Right of Withdrawal

With respect to a distance agreement entered in relation to tutoring lessons, the cooling-off period and the right to annul the agreement during his cooling-off period, that is 14 days after the agreement. However, the customer may not exercise his right in case the first session of the related lesson starts in less than 72 hours. Under these circumstances, 50% of the charged amount in euro will be kept as compensation.

In case of an agreement to provide services, such as tutoring lessons, the cooling-off period starts after the customer has received the confirmation of the agreement.
Article 7 - Delivery and implementation

P&M Network takes the greatest possible care when receiving and when assessing applications for the provision of services.

It is not permitted to change course meetings without the direct and written permission of P&M Network.

P&M Network reserves the right to refuse or cancel consumer’s sessions without prior notice.
Article 8 - Payment

The consumer has the duty to immediately notify P&M Network of inaccuracies in payment data provided or specified.

In the event of a default on the part of the consumer, P&M Network has the right, subject to legal restrictions, to charge the consumer reasonable costs incurred in advance.

In the invent of an overdue invoice, P&M network reserves the right to charge 20% delay fee.
Article 9 – Privacy

P&M Network keeps the information given by customers, such as name and email address in its administration and such information is treated in accordance with the applicable privacy policy.
Article 10 – Intellectual property

All intellectual property, including the materials, are the property of P&M Network.

Nothing may be copied or distributed to third parties without the explicit and written consent of P&M Network
Article 11 – Complaints

Complaints about the services of P&M Network must be sent electronically to the management.

Complaints about the execution of the agreement must be described fully and clearly within three working days after the execution date of the agreement.

The complaints submitted will be answered within a period of 14 days from the day of receipt.

Complaints will not suspend any payment obligation.

If a complaint is granted by P&M Network in relation to a single lesson the customer will be repaid in full. If the customer did not pay the lesson(s) yet and the complaint is granted, the payment obligation no longer exists. If it concerns a series of lessons, there is only a possibility to get repaid after the first lesson under the condition that a complaint has been granted.
Article 12 – Group sessions

Regardless of the number of students on the booking confirmation, the charged amount per person solely depends on the number of students attending the lesson. To that end, a complementary invoice will be sent the day following the session.

In the case of inaccuracy regarding the number of students on the booking confirmation and the number of students attending the lesson, a service fee of 1 euro will be charged to each participant.
